# California AB 960 (20212022) — Compassionate release.

Existing law authorizes a court, upon recommendation for consideration by the Secretary of the Department of Corrections and Rehabilitation, to resentence or recall the sentence of a prisoner if the court finds that the prisoner is terminally ill or the prisoner is permanently medically incapacitated and, in either case, the conditions under which the prisoner would be released or receive treatment do not pose a threat to public safety. Under existing law, a prisoner is terminally ill for the purposes of these provisions if they have an incurable condition caused by an illness or disease that would produce death within 12 months.
